Each state is required to perform inspections and set enforcement procedures to ensure compliance with requirements from the “Technical Instructions.”

From the Technical Instructions are classification of dangerous goods, which identifies the following type of goods, according to their website:

  • Are forbidden under any circumstances;
  • Are forbidden on both passenger and cargo aircraft in normal circumstances but could be carried in exceptional circumstances subject to exemption by the States concerned;
  • Are forbidden on passenger aircraft but permitted on cargo aircraft in normal circumstances; and
  • Are permitted on both passenger and cargo aircraft in normal circumstances

All dangerous goods must be packaged safely, and when in transport, are limited to a certain quantity depending upon the degree of hazard and the aircraft used in transportation.

Operators must inspect each package to ensure it meets requirements. There may be loading restrictions and segregation of packages holding dangerous goods to minimize damage that could potentially occur during movement in flight. In addition, the contents of the packages must be disclosed to the pilot-in-command — should an emergency arise, the pilot-in-command will need to provide air traffic services as to what contents are aboard the plane for emergency services.

This is important because incidents do and will occur. For instance, consider an incident in Aug. 2015 where a consignment of lithium ion batteries caused a fire at Heathrow Airport in the United Kingdom. When one of Heathrow Airport’s handling agents was preforming his duty of breaking down a pallet of cargo that originated from a Hong Kong aircraft, he noticed smoke permeating from a box. Within that box was a woven plastic bag that he quickly removed and place it pallet.

He then used a fire extinguisher to cease smoke from continuing to emanate from the box. Once the smoke stopped, the box was opened and held within were 24 plastic shrink-wrapped cartons that contained a lithium battery that is used primarily to replace laptop batteries. While the outside of the box was not penetrated, one of the batteries had ignited and burnt through a side of the carton.

Lithium-ion batteryThe batteries within the boxes were part of a consignment of 71 various pieces, which were described as holding the following: “Camera accessories, Pet life jacket, Briefcase and bags, Wrist band, Camera, Headset, Lithium ion batteries in compliance with Section II of PI967.” There was an issue with this. According to the ICAO:

The above statement of compliance with Section II of Packing Instruction 967 was not correct since that packing instruction is only applicable to lithium ion batteries contained in equipment, not lithium ion batteries on their own (UN3480), which are required to comply with Packing Instruction 965. It should be noted that the aircraft operator had imposed a prohibition on the carriage of lithium ion batteries on their own and therefore it is possible that there had been a deliberate attempt to avoid the prohibition.

This is a problem because the contents of the package were that the people handling the contents were not properly informed. The fire was attributed to the handling of the contents by the handlers.

Recently, there has been new regulations in relation to lithium-ion batteries. This reform is comprehensive. For the average customer—and even the most seasoned executives—some of the verbiage and jargon can come across as confusing. These reforms have many in the industry insiders scrabbling to conform to the new rules. For many, navigating through the updates can be time consuming.

As one of the industry leaders in shipping, it is imperative that we understand how these updates on regulations affect you and your business. This article has the goal of providing a brief overview of lithium-ion battery news. Being brief, the information provided should be treated as an overview and not as a detailed analysis.

What are lithium-ion batteries?

Lithium-ion batteries are a common type of rechargeable battery, which is found in most consumer electronics.  When lithium-ion batteries are damaged and/or the internal components become wet, the batteries can become highly flammable, making them extremely dangerous—especially in instances where the batteries are packaged incorrectly.

What safe guards are put in place to ensure when shipped these batteries do not explode?

As these batteries evolve—becoming more powerful and used for more applications—so has the world-wide regulatory changes that are taking place to ensure consumer safety. Due to the fact that regulatory agencies and hazmat industry leaders continue to identify potential issues, it is necessary to update regulations, which in most cases are to ensure that proper packaging and shipping of these products are performed. A tight rope is being walked to ensure that the lithium-ion batteries are remaining in line with industry needs.

There are numerous technical requirements identified for different sizes and types of lithium-ion batteries.  Many of these batteries are contained in common consumer products, where the batteries are classified and packaged according to their specific designs.  In general, and as simply put as possible, the lithium-ion batteries must be packed in safe quantities, remain entirely undamaged, stay far away from moisture and heat, and are properly disposed.  Many industry professionals predict that there will be some fire retardant packaging requirements, in some form or another, in the near future for most, if not all of these products in quantities that are deemed dangerous.

Why are the New U.S. OSHA GHS Hazard Classification Guidance Important?

Everyone needs to be aware of the industry and regulatory changes, including the potential damage that can be done when one unscrupulously ignores these rules and regulations. The financial penalties are scary alone but the safety concerns are far more serious and unfortunately overlooked too often.

The bar is set too high to be ignorant to these changes. These updates, in a sense, should be viewed as an accessory to code of ethics. When the updates are ignored, so is the customer’s needs because they can face great danger. Essentially, the more we learn about the industry changes and continue to evolve with them, the world becomes a safer place.

A Brief Summary Of Some of the New Regulations

Below we offer a summary of some of the changes to the regulations.  However, this summary is not comprehensive.  It is intended to be a brief primer.

  • Passenger Aircraft Cargo – Lithium-ion batteries, under Packaging Instruction 965 only, are forbidden as cargo on passenger planes, on an interim basis.  This doesn’t impact batteries that are packed as part of equipment or packed with equipment (Packaging Instruction 967 and 966 respectively).  Source: UN 3480, PI 965, Section IA and IB.
  • State of Charge – Lithium-ion batteries and cells must not be shipped at a state of charge (SoC) that exceeds 30%.  This means that batteries should be fully charged and then drained to 30%, or less, before being shipped.  Source: UN 3480, PI 965, Section IA and IB.
  • Overpacking – Shipping Lithium-ion batteries, cells, and metal, are limited to one 2.5 kg package.  Unless they ship as Class 9, multiple 2.5 kg packages are not permitted. Source.

Lithium batteries offer high charge density in a disposable package that appeals to customers. But it comes at a cost. Lithium batteries can rupture and even explode when short-circuited, a serious liability that has triggered tight restrictions on their air transport.

How can businesses take advantage of the high domestic and international demand for this product while adhering to increasingly strict lithium battery shipping regulations?

The International Air Transport Association has detailed many rules on lithium battery transport. But a basic solution to the shipping question is literally as simple as one, two three: Identifying the right materials, paying extra detail to packaging procedures and thoroughly reviewing the parcel before it’s sent.

Following these steps can ensure you remain within the rules without sacrificing your bottom line.

Lithium Battery Shipping: What’s the Risk?

It might surprise consumers to learn something so commonly used could be dangerous. But hazmat transport experts know how quickly an everyday-item can become a threat. In fact, combusting lithium power packs have been blamed for at least two fatal cargo plane crashes since 2006.

The danger arises when lithium battery terminals come into contact with other batteries, metal objects or conductive surfaces. This contact can cause a short circuit that leads to ruptures and explosions. The result can be lost product, liabilities and even fatalities. It’s clear to see that having the right packaging material and technique is crucial when shipping lithium batteries.

Step 1: Finding the Right Shipping Materials

IATA rules specify that batteries be shipped in a way that prevents their movement and minimizes short circuit risks. Key to safely shipping lithium batteries are materials that can protect the batteries from risks both external and internal.

Externally: Batteries that are not contained in equipment (ie. inside a laptop) should be transported in a strong, sturdy container that has little risk of rupture. Examples might include double-walled, fiberboard boxes. Adding specialized shipping labels can provide an extra layer of security. Taking these extra steps can minimize potential liabilities.

Internally: Again, it’s vital that lithium batteries remain stable during transport to avoid rupture or explosion. Heavy duty bubble wrap is ideal to reduce movement during transport; placing batteries in individual, non-conductive containers (such as plastic bags) further reinforces safety.

Step 2: Proper Packaging Technique

You’ve gathered your materials and it’s time to shift your attention to technique. The focus here is to ensure that the batteries have minimal movement from transport to arrival. For that reason, we suggest you alternate a divider, a layer of bubble wrap or another cushion material such as foam packing, and an individual plastic bag or blister pack for each of the batteries. Ensuring that each battery is surrounded on the top and the bottom by dividers, cushioning and an encasement is the ideal way to prevent mishaps.

Step 3: Review

Once your batteries have been properly cushioned, layered and placed in a strong, protective container, it’s time for a basic review. Give your package a vigorous shake – do you feel or hear movement? If the package is very large, examine each side of the box to ensure it is secure and unlikely to be easily penetrated. If you are using shipping labels, make sure they are easily visible from all sides of the package. These steps may seem fairly obvious, but small mistakes can lead to big mishaps.

Don’t take chances when it comes to transporting lithium batteries. Find the right materials, follow the right packaging technique and take time to review your package. In the end, your product will arrive safely and your customer will be happy.

Lithium Battery Shipping Special Provisions And Prohibitions Checklist

Special Provisions – Allow for the transport of lithium batteries other than in accordance with defined conditions or limits, or which require the shipper to take additional precautions when preparing batteries for transport.

EXCERPT –

Special Provision A88 – Applies to prototype or low production lithium cells or batteries that have not yet passed the UN test requirements in subsection 38.3 of the UN Manual of Tests and Criteria may be transported aboard cargo aircraft, if approved by the appropriate authority of the State of origin and the following requirements are met:

  • Must be approved by the appropriate authority of the State of origin.
  • Cells or batteries are packed in an outer packaging that is metal, plastic, or plywood drum or a metal, plastic, or wooden box that meets the criteria for Packing Group I packing’s.
  • Each cell or battery is individually packed in an inner packaging inside an outer packaging and surrounded by cushioning material that is non-combustible, and nonconductive.
  • Cells or batteries are protected from short-circuiting.
  • Lithium batteries with a mass of 12kg or greater and having a strong impact resistant outer casing, or assembly of such batteries may be packed in strong outer packagings or protective enclosures. The batteries or battery assemblies must be protected against short circuiting.
  • Copy of document of approval from the authority of the State of Origin showing quantity limitations is included.
